1. Parties
Iron and Air Systems (sole trader Adam Daglish, ABN 28 127 768 616) and the Client.
2. Engagement
Engagement begins when the Client confirms a quote in writing (signed quote, written email confirmation, or payment of deposit) or pays for a site visit. Any of these creates a binding agreement.
3. Scope
Work is delivered according to the scope set out in the quote, proposal, or audit report applicable to the engagement. Variations are documented in writing and agreed by the Client before the variation work begins.
4. Pricing
Pricing is as published on the website (/pricing/) and as set out in the engagement-specific quote. Hourly work is capped in writing before commencement.
5. Payment
- Site visits and hourly work: full payment on completion.
- Audits: 100% in advance.
- Packages under $5,000: 30% deposit, 70% on completion.
- Packages $5,000–$15,000: 30% deposit, 40% on parts delivery, 30% on completion.
- Packages $15,000+: 30% / 30% / 30% / 10% staged.
Late payment: simple interest at 10% per annum on amounts unpaid after 14 days.
6. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. For services, you are entitled to cancel the service contract and to a refund for the unused portion, or to compensation for its reduced value. The benefits given by this warranty are in addition to other rights and remedies under a law in relation to the goods or services to which this warranty relates.
7. Liability
Liability for indirect or consequential loss is excluded to the extent permitted by law. Liability for direct loss is capped at the contract price. Nothing in these terms limits ACL statutory guarantees or liability for personal injury or death caused by negligence.
8. Cancellation
Less than 48 hours notice: 50% of estimated labour. Less than 24 hours: 100% of estimated labour. Parts already ordered: full cost charged, Client retains parts.
9. Disputes
Parties negotiate in good faith first. Failing resolution within 21 days, either party may refer the dispute to QCAT.
